Executive Summary
San Francisco-based consumer group As You Sow (AYS) files suits against Lee Pharmaceuticals, Dae Doe Corp. and Zauder Brothers alleging that use of the firms' toluene-containing nail polishes exposes individuals to levels of the ingredient that exceed the level determined by the state of California to cause no reproductive harm. AYS asserts that these products therefore must bear the state's Prop 65 warning statement. According to AYS, the three defendants are among a "handful" of firms that have not settled with the consumer group, and AYS plans to file additional suits against other companies that have not settled. The group has settled with 158 companies to date, some of which were not named in its series of lawsuits on the issue but which chose to settle rather than be subject to future lawsuits.
