HELENE CURTIS PERMANENT WAVE PATENT WAS INFRINGED, JUDGE Ann Williams of the U.S. District Court for the Northern District of Illinois Eastern Division stated in recent consent judgments for the plaintiff. The defendants in the case -- Jacksonville, FL- based Stylors, Phoenix, AZ-based Ken Lange, New Horizon Labs (based in North Andover, MA) and J. Cannon (Forth Worth, TX) -- are permanently enjoined from manufacturing, using or selling permanent wave products containing a cysteamine reducing agent compound covered by U.S. Patent No. 5,260,054, held by Curtis subsidiary Innovative Styling Options. However, making, selling or using other types of products containing a cysteamine reducing agent compound does not infringe the patent, the judgment says. Curtis filed the patent infringement suit Dec. 7 ("The Rose Sheet" Dec. 13, p. 5).
