Executive Summary

Regulatory reform: Interim judicial decisions on individual components of the rulemaking process would not be permitted under an amendment in the nature of a substitute adopted by the Senate Judiciary/administrative oversight & courts subcommittee by voice vote during a March 14 markup of Sen. Robert Dole's (R-KS) Comprehensive Regulatory Reform Act (S 343). Drafted by Subcommittee Chairman Charles Grassley (R-IA), the substitute also amends portions of the Administrative Procedures Act governing agency rulemaking procedures. A substitute amendment offered by Sen. Herbert Kohl (D-WI) that would replace Grassley's amendment with another reg reform bill, S 291, was voted down 4-2, with one "present" vote. The revised version of S 343 was the subject of a March 17 hearing of the full Judiciary Committee. At the hearing, the administration reiterated its concerns about broad applicability of the bill, decisional criteria, excessive judiciary review, its petition processes and its risk assessment procedures...
