Executive Summary
Counterfeit cans of Shaper Hair Spray discovered by the Woodland Hills, Calif.-based salon hair care manufacturer. More than 350,000 cans, imported from Italy, were found to bear the trademarked labeling of the packaging producer used by Sebastian. The cans allegedly contain a "cheap and altered imitation" of the Shaper formula and are thus "prone to clogging," Sebastian says. The counterfeit cans are suspected to have been shipped to the U.S. in May and sold to Albertson's and Phar-Mor stores between June and October. A federal investigation is being led by the U.S. Customs Service with assistance from the Department of Justice. A criminal case may be brought against the offenders followed by a possible civil legal action for damages against Sebastian
