Executive Summary

Procter & Gamble's June 30 motion to dismiss a lawsuit filed by Vidal Sassoon against the firm fails to meet legal standards for the action, Sassoon contends in an Aug. 18 response filed in Los Angeles district court. "Sassoon is under no obligation to prove the claims [against P&G] at this early stage, but only to allege them properly," the document states. Sassoon filed suit in April, claiming P&G, which discontinued the Vidal Sassoon brand in the U.S. in 2002, breached fiduciary duty and implied covenant, in addition to perpetuating actual and constructive fraud in managing the hair care brand. The motion to dismiss is scheduled to be heard by the court Oct. 20 (1"The Rose Sheet" Aug. 11, 2003, p. 5)...
