Executive Summary

Office of Environmental Health Hazard Assessment repeals section of Title 22 of the California Code of Regulations that would have outlined appropriate methods of detection for chemicals regulated under Proposition 65, agency reports in Sept. 17 letter to the public. Decision follows a 45-day comment period and public hearing in which stakeholders were invited to make comments on proposed amendments to or repeal of the act. After reviewing comments, OEHHA decided to repeal the reg because it "fails to provide clarity or certainty for either the regulated community or those involved in the enforcement of Proposition 65 concerning the appropriate methods of detection for chemicals regulated under the act," OEHHA states.
