Executive Summary
The European Commission says Sweden's law on cosmetics and hygiene products "exceeded its obligations under the Cosmetics Directive in a way that hinders the functioning of the internal market" and asks the country to comply with EU's Cosmetics Directive, according to a May 6 release. Swedish law requires notification of products already notified in another Member State and more information for market surveillance purposes than is mandated by the directive. "The directive provides exhaustively for the harmonization of national rules on the placing on the market of cosmetics. ... Member States may not adopt national rules that exceed these requirements in this respect," the EC says. If Sweden does not comply, the case will be referred to the European Court of Justice
